1. Novelle der BBodSchV – Perspektiven für die Verwertung von Bodenmaterial
( Amendment of the German Ordinance on Soil Protection and Contaminated Sites – Perspectives regarding utilization of soil-like materials

abstract:The recycling of soil-like materials is of high relevance for the
circular economy. The planned amendment to the German
Federal Soil Protection and Contaminated Sites Ordinance
contains new requirements regarding the application of soillike
materials below or outside of a rootable soil layer. It
is intended to enable the utilisation of soil-like materials
containing regulated substances between the single and double
precautionary threshold value in solid matter, provided the
new limit values for the eluate are complied with. In a research
project, various soil-like materials were investigated regarding
the effects of the new requirements on the classification. The
results indicate additional recycling potential particularly for
soil-like materials containing PAH when the new regulations
were adopted.)
Die Verwertung von Bodenmaterialien ist für die Kreislaufwirtschaft von hoher Bedeutung. Die geplante Novelle der BBodSchV enthält neue Vorgaben hinsichtlich des Auf- und Einbringens von Bodenmaterialien unterhalb oder außerhalb einer durchwurzelbaren Bodenschicht. Es soll ermöglicht werden, Bodenmaterialien mit Feststoffgehalten von regulierten Stoffen zwischen dem einfachen und doppelten Vorsorgewert zu verwerten unter der Voraussetzung, dass die Eluatwerte eingehalten werden.

abstract: The methodology for determining measurement uncertainty
for implementation of the Federal Soil Protection and
Contaminated Sites Ordinance (Bundes-Bodenschutz- und
Altlastenverordnung (BBodSchV) was further developed and
updated based on data of proficiency tests (2005–2019). In
comparison to the recommendations of the Advisory board for
soil investigations (FBU) from 2008, an improved approach
for modelling of the reproducibility standard deviation and
related uncertainty was developed. With this newly developed
approach, the analytical uncertainty can be calculated as a
function of the contamination level. Especially for elements
it is now possible to determine the analytical uncertainty
specifically. Furthermore, recommendations for new parameters
could be derived.)
Es werden die Ergebnisse zur Weiterentwicklung der Methodik für die Ermittlung der Ergebnisunsicherheit für den Vollzug vorgestellt. Auf der Grundlage durchgeführter Ringuntersuchungen im gesetzlich geregelten Bereich von 2005–2019 konnte die Modellierung der Vergleichspräzision und der damit verbundenen Messunsicherheit im Vergleich zu den Empfehlungen des Fachbeirates Bodenuntersuchungen (FBU) von 2008 deutlich verbessert werden.

( Administrative selection decisions according to the Federal Soil Protection Act

abstract: The article focuses on the demands of the administrative discretion procedure on occasion of selecting the person obliged according to the Federal Soil Protection Act (FSPA). The persons named in Art. 4 (3), (5) and (6) of the FSPA are obliged to remediate harmful soil changes and contaminated sites as well as hereby caused water pollutions. The first half of the article is concerned to the scope of obligation of the persons named in Art. 4 (3), (5) and (6). The second half of the article contains a proposal of guidelines on administrative selection decisions in accordance with the jurisdiction of the administrative courts.)
Der Beitrag befasst sich mit den Anforderungen an die Ermessensausübung bei der Auswahl der Personen, die nach dem BBodSchG zur Untersuchung und Gefährdungsabschätzung bzw. zur Sanierung von schädlichen Bodenveränderungen und Altlasten sowie von durch schädlichen Bodenveränderungen oder Altlasten verursachte Gewässerverunreinigungen verpflichtet sind. In ersten Teil des Beitrages wird auf die einzelnen Verpflichteten näher eingegangen. Im zweiten Teil werden anhand der Rechtsprechung Leitlinien zu Auswahlentscheidungen entwickelt.

( Long-term pump-and-treat remediation actions – Determination of technical fundamentals for the proportionality survey

abstract:Regular reviews of long-term remediation actions are
recommended from an economic and ecological perspective. The
remediation efficiency is hereby evaluated based on the findings
and experiences obtained during the remediation performance.
The guideline “Determination of technical fundamentals to
enable a proportionality analysis of long-term pump-and-treat
remediation actions” comprises an approach for the evaluation
of the technical and conceptual optimization potential, gives
guidance for the evaluation of the remediation efficiency as
well as recommendations for the prediction of the hazard
development after termination of the remediation action.
The guideline was originally developed as a part of the EU
LIFE+ project “MAGPlan” (Management plan to prevent threats
from point sources on the good chemical status of groundwater
in urban areas) and first published in 2012. The guideline was
up-dated according to plan in 2020.)
Aus ökonomischen und ökologischen Gesichtspunkten ist bei langlaufenden Sanierungsmaßnahmen eine regelmäßige Überprüfung der Effizienz unter Berücksichtigung der Erkenntnisse und Erfahrungen aus dem bisherigen Sanierungsverlauf angezeigt. Die Handlungshilfe beschreibt die Vorgehensweise bei der Prüfung des technischen und konzeptionellen Optimierungspotenzials, gibt Unterstützung zur Einordnung der Sanierungseffizienz sowie Empfehlungen zur Prognose der Gefährdungsentwicklung nach dem Beenden einer Sanierung.
